1. Acceptance of Terms

By accessing or using the True Point Precision website (www.truepointprecision.ca) and any associated services, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, you may not use the website or services.

2. Description of Services

True Point Precision sells, rents, services, and supports 3D technologies, including 3D scanners, 3D laser scanning equipment, related hardware, software, accessories, and materials. We also provide reality capture assistance, Scan-to-BIM services, digital twin creation, and other 3D modeling services.

3. User Accounts

Account Creation: To access certain features of the website or services, you may be required to create an account. You must be at least 18 years old to create an account.

Required Information: You may be required to provide your full name and email address. You agree to provide accurate and complete information.

Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

Account Suspension/Termination: True Point Precision reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms and Conditions.

4. Acceptable Use

You agree to use the True Point Precision website and services only for lawful purposes. Prohibited activities include, but are not limited to:

  • Engaging in any illegal activity

  • Spamming or sending unsolicited advertising

  • Attempting to hack or access accounts or systems without authorization

  • Uploading viruses or malicious code

  • Harassment or abusive behavior

  • Infringing on the intellectual property rights of True Point Precision or others

  • Misrepresenting your identity

5. Intellectual Property

All content on the True Point Precision website—including trademarks, logos, text, images, designs, and proprietary materials—is the exclusive property of True Point Precision and protected by intellectual property laws. You may not reproduce, distribute, or use any materials without prior written consent.

Any intellectual property or trade secrets shared with clients remain the sole property of True Point Precision and may not be used outside the scope of agreed-upon activities.

6. Payment Terms

  • Accepted Payment Methods: True Point Precision accepts Bank Transfer or EFT Payments, and approved purchase orders.

  • Extended Payment Terms: Extended terms may be available upon approval and may require references or a credit check.

  • Taxes: Prices are subject to applicable Canadian taxes. Buyers are responsible for all additional taxes, duties, import fees, or cross-border charges.

  • Subscription Services: Subscription-based services may automatically renew. Cancellation requires written notice to True Point Precision.

  • Order Cancellation: True Point Precision reserves the right to cancel or adjust orders due to manufacturer pricing or policy changes. A full refund will be provided if an order is cancelled by us.

7. Shipping and Delivery

True Point Precision aims to ship orders as quickly as possible. However, shipping times may vary based on stock levels and supplier lead times. Shipping estimates are confirmed at the time of order. Delivery may take from next business day up to 5–7 business days, or longer for backordered items.

Shipping, insurance, duty, brokerage, and handling fees are the responsibility of the buyer unless otherwise specified.

8. Returns and Refunds

Returns and refunds are governed by the True Point Precision Return Policy, as outlined below:

True Point Precision Return Policy

If you are not fully satisfied with your purchase, eligible items may be returned within thirty (30) calendar days of receipt, subject to the conditions below.

Non-Returnable Items

Software, digital downloads, subscription services, training, and service work are non-refundable.

Return Eligibility

Returns must meet the following:

  • The return is initiated within 30 days of receiving your order

  • Items must be unused, undamaged, and unmodified

  • All original accessories, manuals, cables, and packaging must be included

  • Items must be repacked in their original packaging

  • Items that come with a software subscription the activation code must not be activated

Return Authorization Required

All returns require an RMA (Return Merchandise Authorization) number.

RMA numbers are valid for 30 days from issuance. If the item is not received within this period, the return will not be accepted.

Return Shipping

Customers are responsible for all return shipping costs and are liable for any damage during transit. We recommend tracked and insured shipping.

Unauthorized Returns

Returns without an RMA will be refused or subject to additional handling fees.

Restocking Fee

A 15% restocking fee may apply to eligible returns to cover inspection and restocking costs.

Inspection and Refusal

True Point Precision reserves the right to inspect and reject any return that does not meet the stated requirements.

Refund Process

If approved, refunds will be issued to the original payment method within 5–7 business days.
If rejected, the customer may have the item returned at their expense.

Exchanges

We do not offer direct exchanges. A new order must be placed.

Damaged or Defective Items

If your product arrives damaged or defective, notify us within 7 days for resolution (replacement, repair, or refund depending on the situation).

9. Warranty Disclaimer

True Point Precision does not provide warranties on products manufactured by third parties. All warranties, if any, are provided by the original manufacturer. To the fullest extent permitted by law, True Point Precision disclaims all other warranties, including implied warranties of merchantability and fitness for a particular purpose.

10. Limitation of Liability

To the fullest extent permitted by law, True Point Precision is not liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from use of our website, products, or services.

11. Indemnification

You agree to indemnify and hold True Point Precision harmless from any claims, losses, damages, liabilities, and expenses (including attorney fees) related to your use of the website, products, or services, or your breach of these Terms and Conditions.

12. Termination

True Point Precision may terminate your account or block access to the website or services at any time for reasons including, but not limited to:

  • Violation of these Terms

  • Engaging in illegal activities

  • Non-payment

  • Abuse of services

13. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any dispute arising from these Terms shall be resolved through arbitration or mediation within Ontario.

14. Changes to Terms

True Point Precision may update these Terms and Conditions at any time without prior notice. Changes take effect immediately upon posting on the website and do not impact orders already in process.
